Is the trademark search really free?
Yes. The preliminary search is genuinely free and comes with no obligation. We do it because clearing a name early is good practice, and because it is how many of our clients first get to know us. If your name looks clear, we will say so plainly. If it does not, we will explain your options, and only then, if you choose to go further with a full clearance or a filing, do our normal professional fees apply, always quoted upfront.
Does my brand need to already be in use before I search?
No. You can search a name you are only considering, one you have just started using, or one you already trade under. The best time to search is before you commit, while changing the name still costs you little. Malaysia allows trademark applications based on an intention to use the mark, so you do not need to have sold anything, or even launched, before you search or apply.
How long does the free search take?

What is the difference between this free search and a full clearance search?
The free search is a preliminary check of the MyIPO register for identical and obviously similar marks in the likely class, giving you a quick sense of risk. A full clearance search goes much further: it examines phonetically and conceptually similar marks, logo and device (image) marks by Vienna classification, pending applications, related classes, common-law and company-name rights where relevant, and comes with a considered registrability opinion. If you are about to invest seriously in a brand, we usually recommend a full clearance before filing, and we will tell you when the free check is enough on its own.

It is not a formal legal opinion, a full clearance search or a guarantee that your mark can be registered or used without conflict. A formal opinion depends on a fuller search and instructions.
