To register a trademark in Malaysia, you must file an application with the Intellectual Property Corporation of Malaysia (MyIPO). The process involves conducting a trademark search to ensure your proposed mark is available, preparing and filing the application under the Trade Marks Act 2019, responding to any examination objections raised by MyIPO, surviving the opposition period after publication in the IP Journal, and finally receiving your certificate of registration. The entire process typically takes 12 to 18 months. Trademark registration in Malaysia generally takes between 12 to 18 months from the date of filing with MyIPO. This includes the examination phase which typically lasts 4 to 8 months, followed by publication in the IP Journal for a 2-month opposition period, and then issuance of the registration certificate. Timelines may be extended if MyIPO raises examination objections or if third parties file opposition proceedings. Once registered, a Malaysian trademark is valid for 10 years from the filing date and may be renewed indefinitely for successive 10-year periods.
The Madrid Protocol is an international treaty administered by the World Intellectual Property Organization (WIPO) that allows trademark owners to seek protection in multiple countries through a single application filed via their home intellectual property office. Malaysia acceded to the Madrid Protocol in 2019, which means Malaysian businesses can now file one international application through MyIPO to protect their trademarks in over 130 member countries.
