File an application with MyIPO under the Trade Marks Act 2019 after a clearance search. The mark is examined, published for a two-month opposition period and then registered, which typically takes 12 to 18 months. A registered trademark agent or patent agent is recognised by MyIPO to file and prosecute applications. An IP lawyer can do that and also advises on licensing and transactions and acts in disputes and court proceedings. Our lawyers are registered as both, so one team can handle trademark agent work, patent agent work and enforcement. Applicants with no business address in Malaysia must appoint a registered trademark agent.
The Madrid Protocol lets a trademark owner seek protection in many countries through one application filed via their home IP office. Malaysia acceded in 2019, so Malaysian businesses can file a single international application through MyIPO instead of separate national filings. It is particularly useful when expanding into ASEAN, Europe or China.
Under the Copyright Act 1987, original literary, musical, artistic and dramatic works, sound recordings, films and broadcasts are protected automatically on creation, with no registration needed. Protection generally lasts for the author's lifetime plus 50 years. Voluntary notification with MyIPO is optional but can be useful evidence of ownership, as our guide to proving copyright ownership explains.
